Milton Keynes Council is leading a request for judicial review to alter the Government’s changes to the Houses in Multiple Occupation (HMOs) planning laws. The new proposals, which aim to give councils greater flexibility to manage shared homes in their local area without getting bogged down in bureaucratic applications, came into force on 1 October. A spokesman for the council said: "These proposals mean the loss of a very important tool to regulate how and where HMOs spring up." The council has also urged the strengthening of powers to use Article 4 directions, which would allow a council to withdraw the automatic planning permission, and require planning applications which could be regulated by conditions. The borough council wants to see Article 4 powers extended together with the removal of the right to claim compensation from ‘would-be’ HMO landlords for potential loss of earnings.
