Ministers are set to argue against homelessness charities
in the Supreme Court over ‘vulnerability test’ criteria used by councils to
prioritise people for homes. Homeless people assessed by councils as
‘vulnerable’ or ‘less able to fend for himself than an ordinary homeless
person’ currently receive priority need for housing help under an assessment
known as the ‘Pereira test’. Government guidance, published in 2006, is based
on this assessment. A spokesperson for CLG said: ‘We want to set out the
government’s long-standing position and [are] therefore applying to the courts
to intervene.’ A lawyer instructed by Crisis said they would argue there are
