Government's New Homes Bonus 'Unlawful'

A conservation charity is warning that the Government's flagship housing scheme, could be unlawful. The Secretary of State for CLG is expected to give a written ministerial statement on the 'New Homes Bonus' (NHB) to the House of Commons today (17 February). But the Campaign to Protect Rural England (CPRE) has said its honorary standing counsel and a fellow legal panel member concluded that the scheme would be unlawful. In its response to the CLG consultation paper in December 2010, CPRE expressed concern "that because any financial benefits derived by the New Homes Bonus would not be directly related to the use and development of land or connected to the application concerned, linking them to planning permissions would be unlawful". The legal opinion suggests that by linking the outcome of planning decisions to financial rewards, any decision taken would be tainted and open to question. Read more on 24dash.
